PT Finetiks Inovasi Indonesia (hereinafter “Finetiks”, the “Company”, “We” or “Us” or “Our”) is a company providing for our users (“User”, “You”, “Your”, “I”, “Me”) to get an assessment and recommendations to improve your financial habits.

These Terms of Use incorporate and should be read in conjunction with Our Privacy Policy. You understand and agree that these Terms of Use is an integral part of the Privacy Policy

We are entitled to change, modify, supplement or otherwise amend this Terms of Use from time to time without the prior notification of our Users, and any of such changes will be shown on this page. By continuing to use Platform after such changes, modifications, supplements and/or amendments to the Terms of Use, you are deemed to agree to such changes, modifications, supplements, and/or amendments. We advise you to periodically review and check for any changes, modifications, supplements and/or amendments of this Terms of Use.

The last changes, amendments, supplements or modifications to this Terms of Use are made on the date referred to in the “last updated on” information above.

ACCEPTANCE OF THIS TERMS OF USE

By using, visiting, accessing or viewing the Platform, You agree that You have read, understand, agree and comply with these Terms of Use and our Privacy Policy including any changes, modifications, additions and/or amendments from time to time.

You understand, agree and acknowledge that these Terms of Use constitute a legally binding agreement between You and Finetiks and that Your use of the Platform will indicate Your agreement of these Terms of Use.

We may release new services, devices and features on the Platform from time to time. Your use of each of Our new services will be governed by these Terms of Use from the time the new services become available.

If You do not agree with these Terms of Use, You must stop accessing or using the Platform. You agree and promise to deactivate or delete your account from the Platform by using the features available on the Platform if you do not agree with these Terms of Use.

This Terms of Use is made to govern the Services that We provide as defined below.

1. Definitions

Except to the extent expressly provided otherwise, in this Terms of Use:

User’s Access shall mean PIN, passwords, security questions and answers, logins and any other information that allows You to access information or Services in the Platform.

Account Data shall mean the data contained in Your account including the personal data You provide to Us and the financial data from your Financial Data Sources.

Losses shall mean any losses, claims, damages, fault, malpractice, negligence, liabilities, obligations, penalties, judgments, arbitration awards, suits, proceedings, and investigation.

Services shall mean the services provided by Us to You through the Platforms as provided in Clause 2 a.

Payment Service Provider” means a third-party payment service provider who cooperates with Us to process, transmit, and facilitate payment methods on the Platform.

Platform(s) shall mean any application, platform digital, website, social media, partner platforms, or any such other platform with the “Finetiks” brand in any form maintained and operated by Us.

PPOB Products shall mean phone credit reloads, electronic data packages, electricity tokens, and other bill payment products provided by the Digital Product Provider.

Digital Product Provider shall mean PT SEPULSA TEKNOLOGI INDONESIA (Alterra Bills) as the phone credit and bill payment aggregator collaborating with Finetiks.

Pending Transactions are Transactions that have not received a Final Status (success/failed) from the operator or Biller within a specific timeframe.

Dispute shall mean any conflict, controversy, or discrepancy in this Terms of Use and Privacy Policy.

Financial Data Source(s) means any financial data on Your financial service provider network which will be integrated with the Platform including but not limited to bank transactions, credit cards, electronic money, electronic wallets, debit cards and deposits that you provide to us in the context of providing services.

Business User A legal entity using the Business Dashboard for corporate financial management.

Partner User: A third party collaborating via the Partner Dashboard.

Authorized User: Individuals (employees/agents) granted access by a Business or Partner User.

2. Our Service(s)

a. Service(s)

We provide You with an overview of Your financial position in which we specifically personalize such insights automatically from Your Financial Data Source and Your actual transactions which then allows You to capture budgeting plans, savings and investments that can be made, protected and dynamically monitored by You.

b. Term of Service(s)

For the purposes of providing the Service, You agree to voluntarily provide Us with the financial data from Your Financial Data Source(s) that You provide independently and processing Your actual transaction data.

You may also carry out changes and update to Your financial data, by submitting such data directly through the Platform.

We hereby grants You a worldwide, non-exclusive, non-transferable right to access and use Platform for the purpose of receiving the Services.

User’s use and access of Platform is subject to any applicable restrictions that may be imposed by Finetiks from time to time, be it by amendment to this Terms of Use, or any other policies that Finetiks is implementing in the future. Therefore, You are advised to check regularly, to allow You to receive the most updated version of this Terms of Use.

User shall maintain and must not share User’s Access, to anyone else, and shall prevent unauthorized access or usage of information, file, or data that You save or use on or with the Services. You are hereby responsible for any communication made through your account accessed using the User’s Access.

c. PPOB & Digital Product Services

Finetiks collaborates with PT Sepulsa Teknologi Indonesia (Alterra Bills) to provide Phone Credit Products (phone credit reloads and data packages) and Bill Payment Products (PLN, PDAM, BPJS, and other bills) to End Users.

In this service, Finetiks acts as a distribution partner facilitating transactions between You and the Biller through a Host-to-Host system.

Transaction Status & SLA: You acknowledge that Pending Transactions (transactions that have not received a Final Status) may require an update period of up to 1x24 hours for Phone Credit Products, and up to 3x24 hours for certain Bill Payment Products if conducted on holidays.

Pricing and Admin Fees: The Sell Price and Suggested Admin Fee are determined by the Digital Product Provider and are subject to change at any time in accordance with the policies of telecommunications operators or Billers.

Complaint Deadline: Any complaints regarding failed or unreceived transactions must be submitted to our customer support no later than D+7 Calendar Days from the transaction date. Inspections cannot be carried out if complaints are submitted beyond this deadline due to data storage policies of the Biller/Source.

d. US Stock and ETF Investment Services

What is investing in Finetiks: Through the Finetiks app, you can easily and securely engage in investment activities. Finetiks partners with trusted providers (like Gotrade) to offer these investment services, including giving you access to buy stocks and ETFs from the United States market. These Terms & Conditions are specifically intended to govern the use of stock and ETF investment services in the United States market (“US Stock Services”) made available through the Finetiks application.

Platform Roles and Responsibilities: (1) Finetiks's Role: PT Finetiks Inovasi Indonesia acts solely as an interface (access provider) routing you to the Gotrade platform. Finetiks displays market data, news, and portfolio views, but does not execute trades. (2) Gotrade's Role: All investment operations to the US Stock Services, including but not limited to account opening, KYC, bank integration, fund deposits, trade execution (buy/sell), withdrawals, and refunds, are strictly processed and managed by PT Valbury Asia Futures.

Legal and Trading Structure: When purchasing assets via the Gotrade Service, you enter into a direct Agreement with PT Valbury Asia Futures, a licensed futures broker supervised by the Financial Services Authority (OJK) in Indonesia. PT Valbury Asia Futures enables access to US stocks via fully-backed contracts. PT Valbury Asia Futures fully backs 100% of its contracts with Alpaca Securities LLC, a FINRA-licensed broker-dealer in the United States. For every share (or fraction thereof) you hold with PT Valbury Asia Futures, there is a corresponding share held by PT Valbury Asia Futures in a segregated brokerage account at Alpaca Securities LLC.

Privacy and Data Sharing: To facilitate seamless access and integration, you consent that Finetiks may share certain identifier data (including but not limited to an User ID or phone/email) with Gotrade solely for the purpose of linking your US Stocks accounts. Once you enter the Gotrade webview, any additional personal data you provide (including but not limited to ID card, tax ID, and biometrics for KYC) is collected, processed, and stored directly by PT Valbury Asia Futures in accordance with their Privacy Policy. Finetiks reserves the right to receive aggregated data regarding your portfolio status and transaction history from Gotrade to display within your Finetiks app.

Service Availability: The Gotrade Services are subject to the operating hours of the United States stock market. Finetiks does not guarantee that access to the Gotrade platform via the Finetiks app will always be available, uninterrupted, or error-free. We are not liable for any losses resulting from system maintenance, API outages, or third-party market data delays.

Account Termination and Unlinking: Deleting the Finetiks app or closing your Finetiks account does not automatically close your Gotrade (PT Valbury Asia Futures) account. Your portfolio and funds remain secure under Gotrade, and you may continue to access them directly through the standalone Gotrade app. To close your investment account, you must submit a request directly to Gotrade.

3. Restriction & Liability

Restrictions and liability applicable for the provision of Services are as follows:

All forms of transactions, fulfillment of benefits, and any form of risk inherent in such financial service products and/or services are the absolute obligation and responsibility of the respective issuing Financial Services Institution (LJK).Limitation of Liability:

Release of Claims: To the extent permitted by applicable law, PT Finetiks Inovasi Indonesia is released from any and all Losses, claims, or legal liabilities arising directly or indirectly due to negligence, system failures, or inherent risks from the products and/or services belonging to the respective LJK.Release of Claims:
  4. We try Our best effort to ensure that the information on the Platform is correct and error free at all times. Despite Our best efforts, We cannot warrant that the Platform will always be error free and that use of it will be fit for purpose, timely and that defects will be corrected, and that that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Platform and we do not make any warranty whatsoever, whether express or implied, relating to fitness for purpose, or accuracy.
  5. The provision of Services by Finetiks to the User is not intended to create, and does not constitute, consultancy relationship or such other similar relationship between User with Finetiks or any person or entity connected with Finetiks. The Services are not to be used as a substitute for competent legal, financial or other professional advice.
    To the extent permitted by law, Users hereby agree to indemnify and hold harmless Finetiks, including but not limited to its shareholders, directors, commissioners, employees, and/or advisors, from and against any and all Losses in connection with the provision of Services.The provision of Services by Finetiks to the User is not intended to create, and does not constitute, consultancy relationship or such other similar relationship between User with Finetiks or any person or entity connected with Finetiks. The Services are not to be used as a substitute for competent legal, financial or other professional advice.
  6. To the extent permitted by law, Finetiks is not responsible, either directly or indirectly, for the accuracy of the financial data you provide from Financial Data Sources.
  7. Data Input Accuracy: You are solely responsible for ensuring the accuracy and correctness of the data entered, including but not limited to mobile phone numbers (MSISDN) or customer identification numbers (Customer ID). Any losses arising from data input errors by You (such as the delivery of Products to the wrong number) are Your full personal responsibility, and such transactions are final and non-refundable.
  8. Pending Transaction Provisions: You acknowledge that Transactions may experience a "Pending" status (not yet received a Final Status) due to network connection issues or system synchronization. Finetiks will provide a final status update within a maximum of 1x24 hours for Phone Credit/Data Products and a maximum of 3x24 hours for certain Bill Payment Products (such as PLN, BPJS, PDAM) if the transaction is conducted on a Friday or holiday.
  9. Complaint Deadline (D+7): You understand and agree that any complaints or inquiries regarding unreceived Transactions, undelivered Products, or other PPOB service failures must be submitted to Finetiks customer support no later than 7 (seven) Calendar Days after the Transaction date.
  10. If a complaint is submitted beyond the 7 (seven) Calendar Day deadline, You acknowledge that technical inspections cannot be performed due to the maximum storage period of Transaction Reports at the Biller or system source, and thus Finetiks and the Digital Product Provider (Alterra Bills) are released from any claims or liability for compensation.
  11. System Disclaimer: Finetiks and Alterra Bills are not liable for any losses, direct or indirect, arising from failures of telecommunications operators' systems, Billers, or technical disruptions beyond Our reasonable control, including but not limited to errors by banking institutions in processing payments.
  12. Individuals registering a business entity warrant that they have the legal authority to bind said entity to this agreement.
  13. Business Users are fully responsible for all activities performed by Authorized Users under their dashboard accounts.
  14. You agree to immediately notify Us if You become aware of any loss, theft, or unauthorized use of User’s Access. We are entitled to reject Your access to Our Services (or any part of it) if We reasonably believe that You have suffered loss, theft or unauthorized usage of the User’s Access, to allow Us to rectify such matter. You hereby indemnify Us against any Losses in relation to such matter.
  15. You hereby acknowledge and agree that We and the appointed third-party shall have the authority to combine the User’s Account Data with data from other persons for data analytic purposes, view insights at the aggregate level such as seeing the average age of Platform Users, gender of Platform Users etc., to the extent permitted by laws and regulations. However, such data will not be directly identified to You or any individuals, for the purpose of certain analytical research, tracking of performance and comparison, and any other matters with the purpose of enhancing customer experience and Services, as well as solving problems and technical support.
  16. In the event that there is a commercial advertisement that is affiliated with another party’s electronic systems which available on the Platform, then you agree to release Finetiks from any responsibility for any actions that you take based on your discretion to access, register and use of services on the other party's electronic system. We recommend You to check the terms of use and the privacy policy of the other party’s electronic system.
  17. You understand that the results of recommendations and assessments of your financial position may be different with the results of assessments or recommendations provided by another similar service providers.
  18. Limitation of Liability: Finetiks is not liable for any financial losses, system failures, execution delays, payment failures, or disputes arising from your use of the Gotrade Services. Any complaints regarding transactions, withdrawals, or account management must be directed directly to Gotrade Indonesia's (PT Valbury Asia Futures) customer support. However, Finetiks may assist in facilitating the submission of your complaints or inquiries to the relevant party.
  19. Risk Warning: Futures and securities trading carry high opportunities and high risks, including the potential loss of your entire capital. The material provided within the Finetiks app is general in nature and does not take into account your specific objectives, financial situation, or needs. This is not an offer, solicitation, or financial advice from Finetiks to buy or sell securities. These financial derivative with underlying assets in the form of securities are recorded on the Jakarta Futures Exchange (JFX) and the Indonesian Derivatives Clearing House (KBI). Before investing, you must fully understand trading activities and the Trading Rules set by PT Valbury Asia Futures.

4. Service Fee

You may obtain the Service for free by Us. However, We reserve Our right to charge fees for the Service in the future.

If and when there is a fee charged for the Services We perform, We will charge You a payment in advance before We can provide the Service to You.

In the event of the fee has been made available on Our Platform, We may cooperate with Payment Service Providers in facilitating payments made on the Platform. By submitting Your payment information on the Platform, You consent to Us providing that information to Payment Service Providers to facilitate payments. You acknowledge and understand that You may become subject to additional terms and conditions applicable to the relevant Payment Service Provider, and We advise You to review and examine the terms and conditions of the relevant Payment Service Provider. You acknowledge and understand that Payment Service Providers may experience unintended technical failures, problems or interruptions in forwarding, processing or transmitting payments made by You to Your bank account or electronic wallet account. In such circumstances, You agree and promise not to make any claim or claim against Us for, any and all damages and losses (including but not limited to loss of money, reputation, profits or other intangible losses) that may arise directly or indirectly due to the failure, problem or technical problem of the Payment Service Provider.

5. Prohibition of Use

You agree not to use, or attempt to use the Platform for any purpose that is unlawful or prohibited by these Terms of Use or any applicable laws and regulations, including but not limited to:

  1. create and/or use any hardware, software, features, and/or other devices for the purpose of manipulating the Platform system or making copies of the Platform or part of the Platform, including manipulation of (i) Content, (ii) crawling/ scraping); (iii) other activities that can reasonably be considered as manipulative actions against the Platform system;
  2. abuse or interfere with the operation of the Platform or the servers or networks connected to the Platform, including installing, transmitting, transmitting, uploading, or otherwise making available any material that contains software viruses, worms, or other computer code, documents or programs designed to interfere with, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  3. Users are prohibited from sharing User Access (PIN/Password) with unauthorized parties.
  4. collect or store personal data about other Platform Users in connection with prohibited behavior and activities set out in these Terms of Use;
  5. impersonate any person or entity, falsely state or misrepresent Your affiliation with any person or entity;
  6. remove any copyright, trademark, or other intellectual property rights notices from the Platform; and
  7. received unauthorized access to any part or feature of the Platform, including taking any action that has a negative impact or causes inconvenience to other Users.

6. Governing Law and Dispute Settlement

  1. This Terms of Use and the provision of the Services are governed by and construed in accordance with the laws of Indonesia.
  2. The parties agree that in the event of any Dispute, arising out of or in relation to this Terms of Use or its performance, the parties will attempt for a period of 30 (thirty) business days after the receipt of a written notice by one of the Party to the other Party on the existence of the Dispute, endeavor to settle the Dispute amicably between the Parties.
  3. If within the period as stipulated above, the Parties are unable to resolve the Dispute amicably through deliberation, the dispute resolution shall be conducted through the following stages:
    • Alternative Dispute Resolution Institution: The User/Consumer has the right to resolve civil disputes in the financial services sector out of court through the Financial Services Sector Alternative Dispute Resolution Institution (Lembaga Alternatif Penyelesaian Sengketa Sektor Jasa Keuangan or LAPS SJK) in accordance with applicable laws and regulations.
    • District Court: If the dispute resolution process through LAPS SJK does not reach a final agreement, the Parties agree that the Dispute must be referred to and ultimately resolved through the exclusive jurisdiction of the South Jakarta District Court.

7. Language

This Terms of Use is made bilingual, in Indonesian and English. In the event of any inconsistency or different interpretation in this Terms of Use between the Indonesian and the English version, You agree that the Indonesian version will prevail to the extent of such inconsistency or conflict, and the relevant English version is deemed to be automatically amended to be consistent with the relevant part of the Indonesian version.

8. Severability

If any provision of this Terms of Use or the application thereof to any situation or circumstance shall be invalid or unenforceable, the remainder of this Terms of Use shall not be affected, and each remaining provisions shall be valid and enforceable to the fullest extent.

9. Entire Agreement

This Terms of Use constitutes the entire agreement between You and with respect to the subject matter of these terms and conditions and supersede and replace any prior version of this Terms of Use.

You may be subject to additional terms and conditions when You use, purchase or access other services, affiliate services or third-party content or material.

10. Notification

We may send receipts, invoices, notifications, newsletters, promotions, alerts and other information through Your registered phone number and/or email address and/or send you a push notification through the Platform in your mobile device. You may opt-out of receiving messages at any time by changing Your preferences and settings on Your account. You acknowledge that opting out of receiving messages and/or any information may impact Your use of the Platform. Nevertheless, you may not opt to choose to not receive certain messages relating to Our Service that we deemed necessary for You.

CONSUMER COMPLAINT SERVICE & CONTACT US

As a form of compliance with consumer protection regulations in the financial services sector, PT Finetiks Inovasi Indonesia provides a complaint service facility for Users with the following procedures and division of authority:

  1. Complaints Related to the Finetiks System: For any complaints specifically arising from or related to system operations, application malfunctions, website issues, User account management, and/or internal aggregation service processes belonging to PT Finetiks Inovasi Indonesia, Users may submit their complaints in writing via our customer service email address at support@finetiks.com.
  2. Complaints Related to Financial Services Institution (LJK) Products: For complaints related to product features, transaction nominals, fund administration, as well as the risks of financial service products and/or services issued by partner LJKs, the User understands that such complaints must be submitted to and will be handled directly by the official consumer service channels (Call Center/Customer Service) of the respective product-issuing LJK.
  3. Facilitator Role: Regarding point (b) above, PT Finetiks Inovasi Indonesia is limited to facilitating information and/or forwarding User complaint reports to the relevant LJK in accordance with applicable legal provisions.
